Respected Sir,

          I, NAME, DESIGNATION would like to submit the following for grant of Grade pay of Rs. 5,400/- to me in comparison with my junior in the cadre and some of the Sr. Accountants in the lower cadre.

          I have joined as Clerk in Office of the Accountant General (A&E) Andhra Pradesh, Hyderabad on DD/MM/YYYY. I have been promoted on passing the Departmental Examination for Accountants/ to Accountants cadre on DD/MM/YYYY. Eventually I have been promoted as Senior Accountant on DD/MM/YYYY. I have completed Section Officer Grade Examination (SOGE) in MONTH/YYYY batch. Later I was promoted as Section Officer (Adhoc) on and subsequently regularized as S O on DD/MM/YYYY. Later I was promoted as Section Officer on DD/MM/YYYY. Later I was promoted to the post of Assistant Accounts Officer on DD/MM/YYYY. On implementation of 6th CPC recommendations Section Officer cadre is merged with Assistant Accounts Officer cadre with grade pay of Rs.4,800/-. However my junior in all respects right from appointment was allowed a grade pay of Rs. 5,400/- on implementation of MACP Scheme (MACPS) as detailed below:

          In this context I submit that the Grade Pay (GP) system was introduced by the Central Govt. based on 6th CPC recommendations duly considering the functions and responsibilities involved in various cadres of Central Govt. staff. Each Grade Pay represents a particular cadre and each cadre who carry out similar functions have a particular grade pay thus making it more reasonable. Hence, GP is attached to the post. Further all the allowances like Transport Allowance, Traveling Allowance, LTC entitlements etc., are based on the Grade Pay only and not on the on the pay or post/cadre of the Government Servant.

          Based on the recommendations of the 6th CPC of Govt. has introduced Modified Assured Career Progression Scheme (MACPS) to Central Govt.. Civilian employees w.e.f 01.09.2008. The scheme envisages grant of three financial upgradations to Group ‘B’, ‘C’, ‘D’ employees on completion of 10, 20 and 30 years of continuous regular service. Further the Annexure I of OM dated 19.05.2009 on MACPS states “Financial upgradation” under the MACPS shall be purely personal to the employee and shall have no relevance to his seniority position. As such, there shall be no additional financial upgradation for the senior employees on the ground that the junior employee in the grade has got higher pay/grade pay under the MACPS.

          In view of the provisions of MACPS, the scheme violates equality in the cadre, as the Govt. has stipulated one Grade Pay for one Cadre. For AAO’s cadre the stipulated GP is Rs. 4800/- either by Direct Recruitment or by Promotion. Whereas this order allows two grade pays for the post of AAO. The administrative action based on MACPS, which clearly violates equality, is arbitrary in nature. The implementation of MACPS allows two Grade Pays for one post, which is nothing but selective discrimination in the Cadre and not allowing anomaly to seniors transgresses the basic feature of the Constitution viz., the Principle of Equality.

          As it is observed from my case, I was appointed as a Clerk and promoted as Accountant and even though I have passed SOGE in MONTH/YYYY, I was not promoted to the SO’s cadre for want of vacancies. Hqrs. Office had implemented a policy for promotion of SOGE candidates on Adhoc basis in 1997. Based on that policy I was promoted to the post of Section Officer on adhoc basis after a long gap of 6 years but not before becoming Sr. Accountant. However, in my junior’s case, even though he was promoted to the post of Clerk much later to me he was promoted to the post of SO(Adhoc) but before becoming a Sr. Accountant thus resulting in applying the benefit of MACPS in his case.
          Further, it is not out of place to mention that some of the AAOs of Office of The Principal Accountant General (A&E) Tamil Nadu have filed an OA No. 967/2009 in Madras Bench of Central Administrative Tribunal(CAT). Hon’ble members of CAT Madras Bench have directed in their Judgement dated 29.12.2010 to grant the Revised Pay to the applicants by extending the benefit of MACP Scheme in favour of the applicants by fixing their Grade Pay at Rs. 5400/- from the date on which the said benefit was extended to the private respondents i.e. Juniors.

          In view of the above I request you to grant me MACPS benefit by allowing Grade Pay of Rs.5400/- from the date my junior was allowed such benefit.
